Company Liquidations

Director Redundancy

 

What options are available when it comes to claiming Director Redundancy? It is widely believed that when it comes to redundancy, company directors are not eligible to claim however you have the same rights as any other employee to do so. The insolvency process can certainly be challenging, which is why we at the Consilium Agency work alongside your insolvency practitioner in managing your claim in a simple and effective way. It is not unusual for directors of insolvent companies to under claim their entitlement to redundancy and other similar statutory payments. 


Employee Redundancy

 

After a company is liquidated there is a 'hierarchy' for payments which need to be made. Your employee's arrears of wages and holiday pay (limited) come before any unsecured creditors. Your employees will need to request a form from the liquidator however in most insolvent liquidations there are not enough funds left in the business to meet the total claim made. Debt Solutions Services

Whilst your creditors are not obliged to stop or reduce interest, we will strive to get the best result for you. 


IVA’s

 

An IVA (Individual Voluntary Agreement) is a formal agreement between you and your creditors (the people you owe money to). It works by you agreeing to repay a percentage of your debt in affordable monthly payments over a given time (typically around five years), and they agree to write off any outstanding debt once your final IVA payment is made. An IVA is a legally binding agreement between you and your unsecured creditors, so there's no chance of them chasing you for the debt. 


Bankruptcy

 

Bankruptcy occurs when an individual's debts are greater than their assets and their expenses are greater than their income. Declaring bankruptcy means an individual is financially insolvent and can be relieved of outstanding debts. If you have been made bankrupt, you don't have to deal with your creditors directly - this will be done by your Trustee or the Official Receiver who will make sure that your assets are shared out fairly amongst your creditors. 


Stop Bailiff’s

 

Bailiffs (also called 'enforcement agents') visiting your home can be a stressful experience but you have rights and you shouldn't be bullied. You should not let a bailiff into your home - it's always best to try to sort out your debt by keeping them outside and speaking through the door or over the phone. Depending on the kind of debt you owe, the bailiff may have the right to force entry by asking a lock­smith to open your door if you won't let them in. It's very unlikely that they will do this - you should still have the chance to pay without them coming in. 


Litigation

 

What kind of cases can be resolved using litigation? There are a wide range of cases which can be resolved using litigation. These can include: Commercial disputes e.g. claims for breach of contract such as damaged goods or recovery of debts; matrimonial matters e.g. determining the extent of a spousal claim in a divorce action; Claims against the state e.g. A judicial review of a planning decision; Personal injury claims e.g. monetary claims arising out of an accident where a person suffered harm; Employment disputes e.g. a claim for wrongful dismissal.


Criminal Law

 

The criminal law sets out the definitions of criminal offences and the rules and procedures that apply when the police investigate an offence they allege you have committed; when the prosecuting authorities charge you; and when you must appear in a criminal court. If you admit the offence or are found guilty, the court will impose a punishment on you, ranging from fines, community orders and imprisonment.
